Your telegram of 16th October case of "Elsbeth" no information of nature required under Article No.10 of Order-in- Council of 4th August last has been furnished by Government of Germany and communications from that Government clearly show that such information would not reach His Majesty's Government therefore provisions of article does not apply to German ships such German ships are accordingly liable to condemnation. No Notification that article 3 of Hague Convention No.6 does not
apply to German ships published in London Gazette nor is such
notification required seeing that conditions laid down in
Article 10 of the Order-in-Council have not been fulfilled. Prize Court must in any case act according to position of affairs existing for the moment and not on hypothetical future changes therein.
